Welcome to Strips. The terms “Strips”, “we”, “us” and “our” refer to Strips. We operate this online store and website, including all related information, content, features, tools, products and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”) set out your rights and responsibilities when you access or use the Services.

By visiting, browsing or using any part of the Services, or by purchasing something from us, you agree to be bound by these Terms and by our Privacy Policy which is available on this website. If you do not agree to these Terms or our Privacy Policy, you must not use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you represent that you are at least the age of majority in your state or country of residence, or that you are the parent or legal guardian of any minor who uses the Services and you have given your consent for that minor to do so.

All product descriptions, specifications and prices are subject to change at any time without notice. We reserve the right to discontinue any product at any time and to limit the quantities of any product or service that we offer to any person, household, region or jurisdiction.

SECTION 3 – ORDERS

When you place an order through the Services, you are making an offer to purchase the product or service you have selected. We may accept or reject your order at our sole discretion. Your order is not accepted until we send you an order confirmation.

We must receive and successfully process your payment before your order is accepted and prepared for shipment. We may cancel or refuse any order for reasons including, but not limited to, product availability, suspected fraud, incorrect pricing or errors in product information. If we cancel or change an order, we will attempt to contact you using the email address, billing address or phone number provided at the time of ordering.

Your purchases are subject to our Refund and Returns Policy, which forms part of these Terms and is available on this website.

You represent and warrant that any products purchased from us are for personal or household use only and are not for resale or export.

SECTION 4 – PRICES AND BILLING

All prices shown on the Services are subject to change without notice. The price charged for a product or service will be the price in effect at the time your order is placed and will be confirmed in your order confirmation email. Unless we state otherwise, prices do not include taxes, shipping, handling, customs fees or import duties.

Prices on our website may differ from prices offered through other channels including physical stores, marketplaces or third party retailers.

From time to time we may run discounts, special offers or promotions. These may be subject to separate terms and conditions. If there is any conflict between promotional terms and these Terms, the promotional terms will apply for that campaign.

You agree to provide current, complete and accurate purchase and account information. You agree to promptly update your account and other details, including your email address and payment information, so we can complete your transactions and contact you if needed.

By submitting payment details, you represent and warrant that
(i) the payment information you provide is true, correct and complete;
(ii) you are authorised to use the payment method;
(iii) charges incurred by you will be honoured by your payment provider; and
(iv) you will pay all charges incurred at the posted prices, including any applicable taxes and shipping fees.

SECTION 5 – SHIPPING AND DELIVERY

We will arrange shipping of products to the address you provide at checkout. Any delivery times shown on the Services are estimates only and are not guaranteed.

We are not responsible for delays caused by carriers, customs, border inspections, incorrect or incomplete addresses provided by you, or events beyond our control.

Risk of loss and title for products pass to you when we hand the products to the carrier. Once the products are with the carrier, any claims for loss or damage must also involve the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

The Services, including all content such as text, graphics, logos, icons, images, audio clips, video, digital downloads, data compilations, product designs and software, as well as the design and layout of the website, are owned by Strips or our licensors and are protected by copyright, trademark and other intellectual property laws.

You are granted a limited, non exclusive, non transferable licence to access and use the Services for personal, non commercial purposes only. You must not copy, reproduce, republish, upload, post, transmit, distribute, modify, create derivative works of, publicly display or perform, or commercially exploit any part of the Services without our prior written consent.

Nothing in these Terms grants you any right, title or interest in any intellectual property of Strips, Shopify or any third party, except for the limited licence described above. All rights not expressly granted are reserved.

The names, logos, product names, designs and slogans used by Strips are trademarks or trade dress of Strips or its affiliates. You must not use such marks without our prior written permission.

SECTION 7 – OPTIONAL TOOLS

We may give you access to tools or features provided by third parties as part of the Services. These tools are provided for convenience and are offered “as is” and “as available” without any warranties, representations or conditions of any kind.

We do not monitor, control or have input into these third party tools. We have no liability for or arising from your use of optional third party tools.

Any use of optional tools offered through the Services is entirely at your own risk and you should ensure that you understand and agree to the terms on which tools are provided by the relevant third party.

We may introduce new features or tools in the future. Such new features or tools will also be considered part of the Services and subject to these Terms.

The Services may contain links to third party websites, resources or content that are not owned or controlled by Strips. These links are provided for your convenience only.

We are not liable for any harm or damages related to your use of third party websites or your purchase or use of products, services, content or resources from third parties. SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is hosted and powered by Shopify. Shopify provides the online e commerce platform that allows us to sell our products and services to you.

Sales and purchases made through the Services are contracts between you and Strips, not Shopify. By using the Services you acknowledge and agree that Shopify is not responsible for, and will not be liable for, any issues arising from or related to your purchases or interactions with Strips, including any loss, damage or injury caused by products or services purchased through the Services.

You release Shopify and its affiliates from all claims, demands and damages arising out of or in any way connected with any dispute between you and Strips.

SECTION 10 – PRIVACY POLICY

Your submission of personal information through the Services is governed by our Privacy Policy, which is available on this website. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

Because our store is hosted by Shopify, some personal information is also collected and processed by Shopify as described in Shopify’s own privacy policy. Your information may be stored and processed in countries other than your own. By using the Services, you consent to this collection, use and transfer of information.

SECTION 11 – FEEDBACK AND REVIEWS

If you submit, upload, post, email or otherwise provide to us any ideas, suggestions, feedback, reviews, testimonials, proposals, plans or other materials (collectively, “Feedback”), you grant Strips a worldwide, perpetual, irrevocable, royalty free and sublicensable licence to use, reproduce, modify, publish, translate, create derivative works from, distribute and display such Feedback in any media for any lawful purpose, including marketing and promotional use.

You represent and warrant that you own or control all rights in and to your Feedback, that your Feedback is accurate and does not infringe any rights of any third party, and that your Feedback complies with these Terms.

We are not required to maintain any Feedback in confidence, to pay compensation for any Feedback, or to respond to any Feedback. We may monitor, edit or remove Feedback that we consider, in our sole discretion, to be unlawful, offensive, misleading or otherwise objectionable.

You must not submit Feedback using a false identity or that misleads us or third parties as to the origin of any Feedback.

If your access is terminated, you remain liable for any amounts due up to and including the date of termination.

Sections that by their nature should survive termination will continue to apply, including but not limited to Intellectual Property, Feedback and Reviews, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Changes to Terms of Service.

Our total liability to you for any claim arising out of or relating to the Services or any product will be limited to the amount you paid to us for the product or service that gave rise to the claim.

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend and hold harmless Strips, Shopify and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers, from any claims, demands, losses, damages, liabilities, costs or expenses, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the Services.

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be deemed severed from these Terms. This will not affect the validity or enforceability of any other remaining provisions.

SECTION 19 – WAIVER AND ENTIRE AGREEMENT

If we fail to exercise or enforce any right or provision of these Terms, that does not mean we waive such right or provision.

These Terms, together with any policies or rules posted on the Services, constitute the entire agreement between you and Strips regarding the Services and supersede any prior or contemporaneous agreements, communications or proposals, whether oral or written, between you and us.

Any ambiguity in the interpretation of these Terms will not be construed against the drafting party.

You agree to submit to the non exclusive jurisdiction of the courts in that jurisdiction for the resolution of any disputes arising out of or relating to the Services or these Terms.
